1. Definitions

1.5 Quotation means the price estimate provided to the Customer for the Service, whether by phone, email, online form, or in person.

2. Scope of Service

2.1 Rubbish Clearance Clapham provides manual waste loading, removal, and disposal services from domestic and commercial premises. The Service may include, where agreed, the removal of household rubbish, bulky waste, garden waste, light construction waste, and general unwanted items.

2.2 The Service does not include cleaning, decorating, repair, or building services unless expressly stated in writing. Our operatives will take reasonable care when collecting waste, but we do not undertake structural work, disassembly of fixtures, or specialist removal services unless agreed in advance.

2.3 Rubbish Clearance Clapham reserves the right to decline the removal of any item that in our reasonable opinion is unsafe to handle, prohibited under waste regulations, excessively heavy, contaminated, or otherwise unsuitable for standard collection.

3. Booking Process

3.1 Customers may request a waste collection or rubbish clearance booking by telephone, email, or online enquiry. You will be asked to provide details including the type and approximate volume of waste, location, access information, and preferred dates.

3.2 Any price or timescale given at the enquiry stage is an estimate only and is subject to confirmation on site. The final price will be based on the actual volume, weight, type of waste, and the labour required.

3.3 Bookings are only confirmed when Rubbish Clearance Clapham has issued a clear confirmation by telephone, text message, or email, and where applicable, when any requested deposit has been received.

3.4 The Customer is responsible for ensuring that the booking details are accurate, including the address, contact numbers, access instructions, parking availability, and the general description of the waste to be collected.

3.5 Rubbish Clearance Clapham will use reasonable efforts to attend on the date and within the time window agreed; however, all attendance times are estimates and may be subject to traffic conditions, operational issues, or unforeseen circumstances.

4. On-Site Assessment and Quotation

4.1 On arrival, our operatives will assess the waste to be removed, access conditions, and any special handling requirements in order to confirm the Quotation before commencing the Service.

4.2 If the volume or type of waste differs significantly from the description provided at the time of booking, Rubbish Clearance Clapham may adjust the Quotation. The Customer will be informed of any change in price before work begins.

4.3 If the Customer does not accept the revised Quotation, Rubbish Clearance Clapham reserves the right to cancel the visit or adjust the Service scope. In such cases, a call-out or minimum charge may apply, as notified in advance.

5. Customer Responsibilities

5.1 The Customer must ensure that our operatives have safe and reasonable access to the waste. This includes providing adequate instructions for entry, ensuring that walkways are clear, and confirming that floors, stairways, and access points can safely support the removal of items.

5.2 The Customer must ensure that any necessary permissions, permits, or third-party consents are obtained before the Service begins, including access through shared areas or controlled parking zones where applicable.

5.3 The Customer is responsible for segregating or clearly identifying the waste to be removed. Rubbish Clearance Clapham is not responsible for the removal of any items not clearly presented or items that the Customer intended to keep if they are not clearly separated from waste.

5.4 The Customer must not present for collection any hazardous waste, including but not limited to asbestos, certain chemicals, solvents, medical waste, gas bottles, explosives, or any materials classified as hazardous under UK law, unless previously agreed in writing and subject to specialist arrangements.

6. Payments and Charges

6.1 All charges for the Service are subject to confirmation at the time of the on-site assessment. Prices are generally based on the volume of waste, weight, labour time, and any additional disposal fees associated with particular waste types.

6.2 Unless agreed otherwise in writing, payment is due immediately upon completion of the Service. Rubbish Clearance Clapham accepts payment by cash, bank transfer, or major debit and credit cards, subject to availability of processing facilities.

6.3 For commercial Customers, credit terms may be extended at our discretion. Any such terms will be agreed in writing. If payment is not received by the due date, Rubbish Clearance Clapham reserves the right to charge interest on overdue amounts at the statutory rate and to recover any reasonable costs incurred in the collection of outstanding debts.

6.4 All prices quoted are exclusive of any applicable taxes, which shall be added at the prevailing rate where required by law.

6.5 Additional charges may apply for waiting time, difficult access, collections outside normal hours, or the handling of specific waste streams that require special disposal arrangements.

7. Cancellations, Rescheduling and Delays

7.1 The Customer may cancel or reschedule a booking by providing as much notice as reasonably possible. Rubbish Clearance Clapham reserves the right to charge a cancellation fee where less than 24 hours notice is given, or where our operatives arrive on site and are unable to carry out the Service for reasons beyond our control.

7.2 If our operatives cannot gain access to the premises, or if the waste is not available for collection at the agreed time, a call-out charge or aborted journey fee may apply.

7.3 Rubbish Clearance Clapham may, at its discretion, cancel or reschedule the Service due to unsafe conditions, extreme weather, operational difficulties, or other events outside our reasonable control. In such cases, we will seek to arrange an alternative appointment at the earliest mutually convenient time.

8. Waste Handling and Environmental Compliance

8.1 Rubbish Clearance Clapham is committed to providing waste collection and rubbish removal services in compliance with applicable UK waste management legislation and environmental regulations.

8.2 All waste collected will be transported and disposed of at licensed facilities, with reasonable efforts made to prioritise reuse and recycling where practicable and economically feasible.

8.3 The Customer confirms that they are the lawful owner of the waste or have the full authority of the owner to arrange its removal and disposal.

8.4 The Customer must accurately describe any waste that may require special handling or disposal, including electrical items, refrigeration units, tyres, batteries, or any material subject to specific regulations. Rubbish Clearance Clapham may apply additional charges to cover the lawful disposal of such items.

8.5 Once the waste has been loaded onto our vehicles and the Service is complete, ownership of the waste transfers to Rubbish Clearance Clapham, except for items we decline to take or which remain on site.

9. Liability and Limitations

9.1 Rubbish Clearance Clapham will exercise reasonable care and skill in providing the Service. However, the Customer accepts that minor scuffs or marks may occasionally occur during the movement of bulky items, particularly in tight access spaces, and that reasonable precautions must be taken by the Customer to protect surfaces and fixtures.

9.2 Rubbish Clearance Clapham shall not be liable for any loss, damage, or expense arising from the Service except where such loss or damage is directly caused by our negligence and is reasonably foreseeable.

9.3 To the maximum extent permitted by law, Rubbish Clearance Clapham excludes all liability for indirect or consequential loss, including loss of profit, loss of business, loss of data, or loss of opportunity.

9.4 Our total liability to the Customer in respect of any single claim or series of related claims, whether in contract, tort, or otherwise, shall be limited to the total amount paid by the Customer for the specific Service giving rise to the claim.

9.5 Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability which cannot lawfully be excluded under UK law.

10. Damage and Claims

10.1 Any claim for alleged damage to property or items must be reported to Rubbish Clearance Clapham in writing within 48 hours of completion of the Service, providing full details and supporting evidence where possible.

10.2 The Customer must give Rubbish Clearance Clapham a reasonable opportunity to inspect the alleged damage before any repair or replacement is carried out. Failure to do so may limit or invalidate any claim.

10.3 Where damage is proven to be caused by our negligence, Rubbish Clearance Clapham may, at its option, arrange for repair, provide replacement, or offer a fair monetary compensation, subject to the limitations set out in these Terms and Conditions.

11. Insurance

11.1 Rubbish Clearance Clapham maintains appropriate public liability insurance and, where applicable, employer liability insurance for the activities we undertake in providing the Service.

11.2 Details of our insurance cover can be made available to the Customer on reasonable request.

12. Complaints and Dispute Resolution

12.1 Rubbish Clearance Clapham aims to provide a reliable and professional waste collection service. If you are dissatisfied with any aspect of the Service, you should contact us as soon as possible, providing your booking details and a clear description of the issue.

12.2 We will investigate any complaint promptly and seek to resolve the matter through discussion, remedial work where appropriate, or reasonable compensation in line with our liability terms.

12.3 If a dispute cannot be resolved directly, both parties agree to consider in good faith any reasonable proposal for mediation or other alternative dispute resolution before commencing formal legal proceedings, where this is practical.

14. Amendments to Terms

15. Governing Law and Jurisdiction

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, the remaining provisions shall continue in full force and effect.

16.2 No failure or delay by Rubbish Clearance Clapham in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

16.3 These Terms and Conditions constitute the entire agreement between Rubbish Clearance Clapham and the Customer in relation to the provision of the Service and supersede any prior understandings or agreements, whether written or oral.
